Thank you for choosing Shzam, we want to make sure that you are satisfied with the service provided. Your purchase of and payment for 1-1 sessions or group classes/courses shall be regulated by this Refund & Payment Policy.
PLEASE READ IT CAREFULLY BEFORE MAKING A PAYMENT AS IT DETERMINES YOUR
RIGHTS WITH REGARD TO YOUR PURCHASES, INCLUDING ESSENTIAL RESTRICTIONS
AND EXCLUSIONS.
Shzam seeks to establish a clear and transparent understanding of financial relations between Students and Tutors with respect to the services we provide. This policy applies to all services and features made available through the Website and any related Shzam mobile device application (collectively, the "Shzam Platform”). Capitalized terms used and not defined in this Policy shall have the respective meanings ascribed to them in Shzam Terms of Service.
1.) Transactions
Shzam facilitates contracts between Users (Students and Tutors) by providing a platform to request, deliver and pay for tutoring services. Shzam is only a platform and in no event shall be a party to any contracts between Tutors and Students, or be responsible for any other service or materials provided by a Tutor. Shazam does not monitor any transactions between the Students and the Tutors and shall in no way be responsible for them.
2.) Billing Currency
Payment transactions will be processed in USD only.
3.) Processing Fee
Shzam charges the Students a processing fee for the use of the Shzam Platform. The processing fee will be applied to each purchase made on the Shzam Platform and shall be equal to 8% of the total purchase amount. The applicable processing fee will be displayed at checkout. Notwithstanding the foregoing, Shzam may change the fees for your use of the Shzam Platform for temporary periods of time, and such changes will be effective when addressed on the Site or as communicated via email correspondence.
We reserve the right to change the processing fee at any time.
4.) Cancellation
i.) For one-on-one lessons: Each tutor sets his/her own cancellation policies. Please refer the tutor profile for details.
ii.) Group lessons: Each tutor sets his/her own cancellation policies. Please refer the tutor profile for details.
5.) Rescheduling
You can easily reschedule one-on-one lessons/group lessons through your Shzam account by clicking the corresponding button in the Sessions section for the scheduled lesson within the timeframe specified in this section. You will be asked to provide a reason for cancellation which, in most cases, will be forwarded to your Tutor.
6.) Tutor Selection
A student is welcome to change between tutors whenever he or she wishes.
7.) Reported Issues and Refunds
i.) You are required to report an Issue to receive a refund.
ii.)If you were dissatisfied with your session, a refund can be made at the Tutor's discretion, but the Tutor is not obligated to do so. If you are dissatisfied with your tutor’s resolution, you may escalate your report to the administrators who will make a final refund determination at their sole discretion.
iii.) If you request a refund, its speed and the availability of refunded funds on your bank account will depend solely on the terms and policies of your bank.
iv.) No refund will be issued in case the User has lost and/or forgotten their login credentials (username and passwords), which has resulted in the loss of data, temporary loss of access to the User's account, or any other inconveniences for the User
v.) No refund will be issued in case the User has lost connection due to the absence of Internet access, factory reset or updates.
vi.) Any and all refunds will be deposited into the user’s Shzam wallet.
vii.) To the fullest extent permitted by law, any refunds at any time are at our sole discretion only.
8.) Account Expiration
In case you haven’t logged into your Shzam account for more than 365 days, your account will be suspended and your remaining balance will expire.
9.) Account Deletion
i.) If you decide to delete your Shzam account, your remaining balance will expire.
ii.)In case Shzam suspends or terminates your account due to the breach of any of our policies, you understand and agree that you shall receive no refund or compensation for any unused balance or scheduled lessons/classes.
10.) Payments
i.) Payment processing on the Shzam Platform is provided by third-party payment processors including, but not limited to Stripe allowing us to (a) bill the Students in lieu of directly processing the credit/debit card information; and (b) enable payouts to the Tutors.
ii.) To avoid any doubt, payment made by the Student to Shzam shall satisfy the Student’s obligation with respect to the payment to the Tutor for the tutoring services provided via the Shzam Platform.
iii.) All transactions are secured as third-party payment processors use SSL encryption protection.
11.) Data That You Provide
i.) The billing information provided by you is processed by third-party payment processors only. We do not collect, store or otherwise process your billing information.
ii.) We are not responsible for any failures of the third party to adequately protect such information. The processing of payments will be subject to the terms, conditions, and privacy policies of third-party payment processors in addition to this policy.
12.) Payment Methods
Payment methods available on the Shzam Platform are as follows:
I.) Stripe (Gpay, Visa/Mastercard/Amex/Discover)
ii.) PayPal
13.) Limitations to Process Payments
i.) All payments for the use of the Shzam Platform and the tutoring services shall be made through the Shzam Platform.
ii.) Students are liable for all transaction fees related to the payments for the use of the Shzam Platform and the tutoring services.
14.) Bonus for the Tutors
i.) The administrator can reward tutors with an end-of-the-year bonus. The admin can set an interval dollar amount and an associated percent of commission funds to be returned.
ii.) The interval to calculate the bonus starts from January 1st to December 31st of the year, with the first year of calculations starting in 2024.
15.) Payouts
i.) Tutors can receive payouts via Paypal or bank transfer. The tutor must have a paypal account and associated email address for the former and a bank account for the latter. All usual banking credentials are needed for the bank payout. Tutors must submit a request to initiate a Payout.
ii.)Please note that third-party payment processors charge a fee for every transaction. Such transaction fees shall be deducted from the respective payout amount and will be displayed within the Shzam Platform functionality.
16.) Miscellaneous
Shzam is not a bank or any type of financial institution and does not provide any financial services or advice. Any payments made via the Shzam Platform are made solely for the purpose of access, facilitation and delivery of the tutoring services between Students and Tutors. Such payments may not be made and used for any fraudulent, criminal or illegal activity as defined by the law.
